Hereinafter referred to as the “Seller”.

2. Scope of these Terms and Conditions

These Terms and Conditions apply to the online sale of physical products offered by the Seller through the www.evetke.com online store, primarily clothing and accessories.

The online store does not sell digital content or digital services.

By submitting an order, the Customer accepts the version of these Terms and Conditions in force at the time the order is placed.

The language of the contract is Hungarian. Any foreign-language version of the online store and these Terms and Conditions is provided to assist international Customers.

Contracts concluded through the online store are considered contracts concluded electronically. They are not filed separately by the Seller and are not considered written contracts.

3. Products

The online store offers Evetke clothing and accessories.

Each product page contains the essential characteristics of the relevant product, including its name, price, available sizes and, where applicable, material composition, colour and other relevant features.

The Seller makes every reasonable effort to ensure that product photographs represent the colours and appearance of the products as accurately as possible. However, colours displayed on different screens and devices may vary slightly from the actual colour of the product.

Evetke products are made in small series. Certain products are produced only after an order has been received.

This fact in itself does not affect the consumer’s statutory right of withdrawal.

4. Prices

The current purchase price of each product is the price displayed on the relevant product page and in the order summary.

The Seller is exempt from VAT; therefore, the displayed prices do not include VAT.

Any applicable delivery charge is displayed at checkout before the order is finalised.

The Seller reserves the right to change the prices displayed in the online store. Any price change will not affect orders that have already been confirmed.

In the event of an obviously incorrect price being displayed, the Seller is not obliged to supply the product at the incorrect price. In such cases, the Seller will inform the Customer of the correct price, after which the Customer may decide whether to proceed with or cancel the order.

5. Ordering Process and Conclusion of the Contract

The Customer may add the selected product to the shopping cart after selecting the appropriate size and any other available product options.

At checkout, the Customer provides the information required to fulfil the order, selects an available delivery method and pays for the order by bank card.

Before submitting the order, the Customer has the opportunity to review and correct the information provided.

Submitting an order creates an obligation to pay.

The Seller sends an automatic e-mail confirming receipt of the order. If the order cannot be fulfilled – for example, because a product has become unavailable – the Seller will inform the Customer without undue delay and refund any amount already paid.

6. Payment

Payment in the online store can only be made by bank card.

Payments are processed through the secure electronic payment system available through the online store.

The bank cards and payment providers currently accepted are displayed at checkout.

The Seller does not have access to or process the Customer’s full bank card details.

An electronic invoice is issued for the order and sent to the Customer electronically.

7. Delivery

The Seller delivers orders within Hungary, to countries of the European Union, and to selected countries of the former Yugoslavia.

The delivery methods currently available and the applicable delivery charges are displayed at checkout before the order is finalised.

Within Hungary, the Seller primarily uses FOXPOST and GLS delivery services.

Depending on the selected delivery option, orders may be delivered to a parcel locker/collection point or directly to the delivery address provided by the Customer.

Personal collection is not available.

For international orders, the available delivery method and delivery charge depend on the destination country and are displayed at checkout.

For deliveries to countries outside the European Union, customs duties, taxes or other import charges may apply. Unless otherwise stated, any such charges imposed under the laws of the destination country are payable by the Customer.

8. Preparation and Delivery Time

Evetke products are made in small series, and many items are produced after the order has been received.

The usual preparation time for an order is 3–10 business days.

The delivery time required by the relevant shipping provider is additional to this preparation time.

If the preparation or delivery of a product is expected to take longer, the Seller will inform the Customer accordingly.

In the case of a consumer contract, unless otherwise agreed, the product must be made available to the Customer no later than 30 days after the conclusion of the contract.

9. Right of Withdrawal

A Customer who qualifies as a consumer has the right to withdraw from the purchase without giving any reason within 14 days of receiving the product.

If multiple products are delivered separately on different dates, the 14-day withdrawal period begins on the date the last product is received.

The consumer may also exercise the right of withdrawal before receiving the product.

The Customer must inform the Seller of the decision to withdraw by means of a clear statement, for example by e-mail at:

evetkeswear@gmail.com

After notifying the Seller of the withdrawal, the Customer must return the product without undue delay and no later than 14 days after communicating the decision to withdraw.

The direct cost of returning the product is borne by the Customer.

The Seller is not obliged to accept parcels returned cash on delivery or with postage due.

The Customer may try on and inspect the product to the extent necessary to establish its nature, characteristics and functionality. The Customer may be held liable for any reduction in the value of the product resulting from handling beyond what is necessary for this purpose.

10. Refunds Following Withdrawal

In the event of a valid withdrawal, the Seller will refund the amount paid by the consumer, including the cost of the standard original delivery.

If the consumer selected a delivery method that was more expensive than the least expensive standard delivery option offered by the Seller, the Seller is not required to refund the additional delivery cost.

The refund will be made no later than 14 days after the Seller has been informed of the Customer’s decision to withdraw.

The Seller may withhold the refund until the returned product has been received or until the consumer provides reliable evidence that the product has been returned, whichever occurs first.

Unless otherwise agreed, the refund will be made using the same payment method used for the original transaction.

11. Customised and Personalised Products

The right of withdrawal does not apply to non-prefabricated products made according to the consumer’s specific instructions or requests, or to products that are clearly personalised for the consumer.

A standard Evetke product ordered in a size, colour or variation normally available in the online store does not automatically qualify as a customised product simply because the item is produced after the order has been placed.

If a product is made according to the Customer’s individual requirements – for example, according to custom measurements, with modifications that are not part of the standard range, or with other forms of personalisation – the Seller will clearly inform the Customer of this before the order is placed.

12. Defective Products – Statutory Warranty

The Seller is responsible for ensuring that products comply with the contract and the applicable legal requirements at the time of delivery.

In the event of defective performance, consumers may exercise their statutory warranty rights in accordance with applicable law.

The consumer may primarily request repair or replacement, unless the chosen remedy is impossible or would result in disproportionate additional costs for the Seller.

Where the conditions provided by law are met, the consumer may request an appropriate reduction in price or terminate the contract.

In contracts between the Seller and a consumer, statutory warranty claims generally expire two years after delivery.

Customers are advised to report any defect as soon as possible after discovering it.

Warranty claims may be submitted using the following contact details:

E-mail: evetkeswear@gmail.com
Postal address: 6722 Szeged, Mérey utca 16., Hungary

When submitting a claim, Customers are requested to provide their order number, a brief description of the defect and, where possible, a photograph showing the defect.

Providing a photograph may assist the Seller in assessing the claim but is not, in itself, a condition for exercising statutory warranty rights.

13. Product Warranty

In the event of a defective produ
